1. Who you are contracting with

PROPTRAC (the "Service") is provided by PROPTRAC ("we", "us", "our"). By creating an account, accessing or continuing to use the Service, you agree to these Terms & Conditions. If you do not agree, you must stop using the Service.

2. The Service

PROPTRAC is a web-based property investment portfolio tool for tracking property values, bonds, rental income, expenses, cash flow projections, contacts and related documents. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have subscribed to.

3. Your account

  • You must provide accurate information and keep it up to date.
  • You are responsible for keeping your login credentials confidential.
  • You are responsible for all activity that occurs under your account.
  • If you use the Service on behalf of a business, you confirm you have authority to bind that business; otherwise you confirm you are of legal age to contract.

4. Acceptable use

You must not misuse the Service. In particular, you must not:

  • use the Service for any unlawful purpose;
  • commit fraud, send spam, or upload malicious code;
  • infringe the intellectual property or privacy rights of others;
  • probe, scan, scrape or otherwise interfere with the security or integrity of the Service;
  • reverse engineer, resell, redistribute or circumvent technical limits of the Service.

5. Your content

You retain ownership of the property data and documents you upload. You grant us a limited licence to host and process that content solely to provide the Service to you.

6. Intellectual property

We retain all ownership and intellectual property rights in the Service, including its software, design, documentation and branding. Nothing in these terms transfers those rights to you.

7. Payment and subscription terms

The Service is sold as a monthly subscription of R350 per month (ZAR), preceded by a 7-day free trial. Subscriptions renew automatically each month until cancelled. You may cancel at any time and retain access until the end of the period you have paid for.

Payment, billing, currency, tax, invoicing, cancellation and refund mechanics are handled by our reseller Paddle and are governed by the Paddle Buyer Terms.

8. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Service level and warranties

We work to keep the Service available and accurate, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Figures, projections and calculations produced by the Service are informational only and are not financial, investment, legal or tax advice; you remain responsible for your own decisions.

10. Suspension and termination

We may suspend or terminate your access where there is material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. On termination your access ends; you may request an export of your data within 30 days, after which it may be deleted.

11. Liability

To the extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim. We exclude liability for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing excludes liability for fraud, death or personal injury where the law does not permit exclusion.

12. Indemnity

You indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.

13. General

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. We may update these terms and will post the revised version on this page.
